For membership agreements entered into after 1st April 2023:
Gym One Fitness is the trading name of Gym 1 Fitness Ltd, a company incorporated in England and Wales with registered number 1455076.
In these terms and conditions (‘you’ and ‘your’) means you the member, (‘we’ ‘us’ and ‘our’) means Gym One Fitness.
All memberships are subject to: (1) these Terms and Conditions of Membership; (2) the General Terms and Conditions of Use of Gym One Fitness; and (3) the rules and regulations issued by Gym One Fitness from time to time. By agreeing to become a member of Gym One Fitness, you accept and agree to comply with all terms, conditions, rules and regulations. These terms and conditions take precedence over any previous terms and conditions or any oral representations made.
We offer different types of gym membership (fees vary between membership and types):
12 Monthly Membership – Contract
Monthly Membership – rolling No Contract plus joining fee
PAYG (Pay As You Go)- Yearly and Monthly
PAYG (Pay As You Go)- 3 Months
PAYG (Pay As You Go)- weekly
PAYG (Pay As You Go)- Daily or per session
All memberships are sold on an opening hours basis.
To qualify for concessionary membership rates you will be required to supply evidence of your eligibility. This must be presented when joining the gym or on your first visit to the gym. Evidence for concessionary rates can be presented in the form of your birth certificate, driving licence, passport, a current NUS Student Card
Your membership is personal to you and cannot be loaned, sold on or transferred to another person. Members who lend or attempt to sell their membership will have their card rescinded without a refund.
Membership may be refused or rescinded with good reason at the discretion of the GYM ONE FITNESS management and admission to GYM ONE FITNESS premises may also be refused to any member or their guest at the discretion of the management.
We can change the agreement at any time. We will give you 14 days’ notice of this change in writing to the e-mail address you have given us.
Before using any exercise equipment or attending a class you must read and sign the Health Commitment Statement/Pre Activity Questionnaire (PAR-Q). We offer a free supervised induction session when you join however you do not have to take up the offer. We can refuse access to the gym facilities if we consider your health maybe adversely affected by the use of such facilities. In such circumstances you will be referred back to your GP for assessment.
Members and guests must accept responsibility for their personal property whilst on the premises and GYM ONE FITNESS shall not be liable for any loss, damage or theft or personal property.
Every member and guest must comply with the reasonable instructions of staff in the interests of health and safety and maintaining smooth running of the gym.
Only personal trainers approved by the management may use the facilities to train customers.
Members and guests must exercise due care in particular when using the facilities and/or equipment so as to avoid injury to themselves and others using the gym and those in any doubt about their physical fitness should seek medical advice before attending the gym. GYM ONE FITNESS shall not be responsible for any injury occurring on the premises whether as a result of the use or misuse of the facilities and/or equipment provided by them.
2.1 If you have a 12 Month Membership you will be committed to a minimum of 12 months’ membership.
2.1.2 Your membership fee must be paid in monthly instalments for a minimum of 12 months and the commitment period begins on your membership start date.
2.1.3 Monthly instalments are paid by Direct Debit (Via Go Cardless), in advance of us providing the services for the month to which the payment relates.
2.1.4 If you cancel your Direct Debit (Via Go Cardless), payment during the minimum term, all unpaid monthly instalments that are due or to fall due during the minimum term shall become immediately due and payable by you.
2.1.5 It is important for you to note that you cannot cancel or downgrade your 12 Month Membership to another form of membership during the minimum term.
2.1.6 If you want to cancel your 12 Month Membership on expiry of the minimum term (on the expiry of the 12 months’ period) you must give us 1 calendar months’ advance notice otherwise the membership will renew for a further 12 months automatically.
2.1.7 When paying by Direct Debit, you will be directed to the closest payment date available. If you do not take this date an initial payment (Pro Rata) will be required to cover the period up to your first DD payment. Therefore, your first payment may be slightly higher.
2.1.8 GYM ONE FITNESS or the bank/building society makes a mistake with your direct debit payment you are guaranteed a full and immediate refund from your bank/building society.
2.2.1 If you have a Monthly Membership (rolling No Contract plus joining fee) you will be committed to a minimum 1-month term.
2.2.2 If you have a Monthly Membership (rolling No Contract plus joining fee) you can terminate this at any time, upon termination you will no longer be able to access the gym.
2.2.3 Your membership fee must be paid monthly, by Direct Debit (Via Go Cardless), in advance of us providing the services for the month to which the payment relates.
2.2.4 It is important for you to note that you cannot cancel or downgrade your Monthly Membership to another form of membership during the minimum 1 month-term.
2.2.5 If you want to cancel your Monthly DD on expiry of the minimum term (on the expiry of the 1 months’ period) you must give us 1 calendar months’ advance notice otherwise the membership will renew for a further 1 months automatically.
2.2.6 If you cancel your DD at the bank without notifying us within the minimum term of membership, Gym One Fitness will endeavour to recover that months’ fee and an administration fee will apply. If the latter does occur and you would like to join as a member again, then a joining fee will apply again.
2.2.7 If you wish to cancel and then re-join, a joining fee will be applied. This will only apply after a period of 2 months have elapsed.
2.3.1 If you have an Upfront Prepaid Membership you will be committed to, and you must pay us in advance, and in full for, the agreed minimum membership period ie 1 day, 1 week, 1 month, 3 months 12 months or whatever minimum membership period is applicable to your particular pass.
2.3.2 It is important for you to note that you cannot cancel or downgrade your Upfront Prepaid Membership to another form of membership and this membership, once paid for, is non-refundable.
2.3.3 The following provisions do not apply to the Prepaid Membership Pass:
2.3.4 You cannot cancel a Prepaid Membership Pass; it will expire automatically without notice.
2.5. The day rate entitles you to use the gym for one day only. A free day pass may be offered to customers at the discretion of the GYM ONE FITNESS management. Customers will not be permitted to use more than one free day pass. All free day passes must be presented at the reception before entering the gym.
2.6. A weekly pass is valid for 7 continuous days from the date of purchase. It entitles you to use the gym at anytime for the 7 day period.
2.4.1 Subject to the provisions of this clause you cannot cancel or downgrade your membership during its minimum term.
2.4.2 Any cancellation of your membership must be made via email to the gym on hello@gymonefitness.com. For all cancellations we require a cancellation reason and requested date to stop the membership. Evidence may be required on occasions
2.4.3 If you cancel and then re-join in the future a joining fee will apply in all circumstances.
2.4.4 Joining fees and subscriptions will not be refunded. We hope that Gym One Fitness provides everything you expected. However, if you do change your mind within 7 days of your start date, we will allow you to cancel your membership but your joining fee, or if no joining fee was payable a minimum of £30, will not be refunded.
2.4.5 If you wish to terminate your membership on expiry of the minimum term you must give one full months’ notice in advance of expiry of the minimum term.
It is your obligation to ensure that your contact details are up to date. Please ensure any changes to your postal or email address or telephone number are notified to us or through the Club Manager App. We cannot be responsible for any communications that you do not receive because you did not update your contact details with us.
2.6.1 If you do not pay your membership fee we will contact you to let you know.
2.6.2 We may refer any missed payments to a debt collection agency.
2.6.3 If you do not pay your membership fees for more than 30 days, we may at our discretion charge you an administration fee of £25. Every individual retries will occur an admin fee of £10 per try.
2.6.4 If you do not pay for your membership we will prevent you from using the gym.
2.6.5 If you want to change your Direct Debit details you can do so by contacting us during staffed hours on our telephone number or you can email hello@gymonefitness.com. Failure to do so will result in the payment being requested from your existing card – should there be insufficient funds to cover the payment you may incur bank charges. Each additional retries will incur a fee (see 2.6.3)
2.8.1 We reserve the right to increase prices of the membership at any point during the term of the membership.
2.8.2 We reserve the right to pass on in full any changes in the prevailing rate of Value Added Tax (V.A.T.).
2.8.3 Promotions do not apply to existing members.
2.9.1 You may request to freeze your membership by contacting the gym. You must notify us by sending an email to hello@gymonefitness.com or gymonefitness@outlook.com. Membership may be frozen at our absolute discretion for a minimum of 2 months and a maximum of 5 months (apart from in exceptional circumstances), such period to be agreed at the time of freezing the membership.
2.9.2 A charge of £7.50 per month will be levied for the duration of the freeze period. This will cover the DD costs.
2.9.3 Full membership fees will be re-instated and will commence from the agreed commitment to return date received from you.
2.9.4 Periods during which the membership is frozen do not form part of the continued duration of a 12 Month Membership and periods for which the membership is frozen will be added on to the contract term, extending the minimum term.
2.9.5 You must fully re-instate your membership subscription from frozen to active membership and been running for 1 month before terminating your membership.
2.9.6 You will not have access to use the club facilities whilst your membership is frozen.
2.9.6 Membership freezing will not apply to PAYG. PAYG may be frozen at the discretion of GYM ONE FITNESS management.
3.1.1 Access to the gym will be via a barcode membership card which is collectable from the gym reception.
3.1.2 The memberships card cannot be used by any other member other than the member it has been given too, to access the facilities.
3.1.3 If a member is found to be given the membership card to a non-member. The active member will have his membership revoke without compensation.
3.1.4 You must scan your membership card at reception when accessing facilities; otherwise we will charge you the standard day rate.
3.1.5 All members must have their photograph taken for identification purposes; this will be stored on GYM ONE FITNESS Ltd Data base. This information will solely be used by GYM ONE FITNESS and will not be released to any third parties other than Go Cardless and Club Manager System.
3.1.6 If you lose your membership card, we will charge a fee to replace it. A charge of £0.50p will be charged to replace the membership card
3.1.7 GYM ONE FITNESS Ltd may open/close earlier during public holiday periods. Facilities may also close or open for occasional special events
3.1.8 Notices will be displayed in the club in advance notifying customers of any changes. No refunds will be available for these periods.
3.1.9 We may change gym opening times or withdraw any of the facilities at any time if we need them for events, tournaments, exhibitions or other special activities.3.1.10 We may need to close a facility or part of it for repair/refurbishment on the grounds of health and safety or improving customer service.
In the above circumstances we will use our best endeavours to:
Give as much notice as is reasonably practicable by displaying notices in the gym.
Your membership does not give you priority over other users or guarantee the availability of facilities.
3.3.1 For security reasons and the benefit of other members you must ensure that all lockers are emptied at the end of each visit.
3.3.2 All lockers will be checked and emptied at the end of each day. If any contents remain we will retain any belongings for four weeks after removal after which we reserve the right to dispose of the contents in a responsible manner. We will not be responsible for any loss in this regard.
Smoking and the use of vapours is prohibited in all areas of Gym One Fitness premises.
We do not accept liability for loss, theft or damage to any personal belongings.
